VALUE VELO – TERMS OF SERVICE

Please read these Terms of Service carefully before accessing or using our website or purchasing our products. By accessing the site or purchasing a pre-owned bicycle from Value Velo, you agree to be bound by these Terms.

1. Pre-Owned Merchandise & Condition Disclaimer

Value Velo specializes in the retail sale of pre-owned, used, and refurbished bicycles, components, and accessories.

  • Cosmetic Variation: You acknowledge and agree that pre-owned bicycles inherently exhibit cosmetic imperfections, including but not limited to scratches, paint chips, scuffs, and minor surface wear. These cosmetic irregularities do not constitute product defects.
  • Refurbishment: While every bicycle undergoes a multi-point mechanical safety inspection by our technicians prior to sale, components on pre-owned bicycles have varying degrees of prior mileage and wear.

2. The 30-Day Limited Warranty

Value Velo provides a sole, exclusive 30-Day Limited Shop Warranty on qualified pre-owned bicycles, beginning strictly on the date of delivery or local pickup.

  • Scope of Coverage: This limited warranty strictly covers unexpected mechanical failures of the frame, rigid fork, derailleurs, and shifters due to pre-existing defects in materials or workmanship.
  • Exclusions from Coverage: This warranty does not cover:

    1. Normal wear-and-tear components (including but not limited to tires, tubes, brake pads, cables, housings, grips, saddles, and chains).
    2. Damage resulting from accidents, crashes, impacts, neglect, misuse, abuse, commercial use, stunts, jumping, or racing.
    3. Bicycles modified, altered, or repaired by anyone other than a Value Velo technician without prior written authorization.

3. Absolute Disclaimer of All Other Warranties ("AS IS" Sale)

EXCEPT FOR THE EXPLICIT 30-DAY LIMITED WARRANTY PROVIDED IN SECTION 2, ALL BICYCLES, PRODUCTS, AND SERVICES ARE PROVIDED BY VALUE VELO ON AN "AS IS" AND "AS AVAILABLE" BASIS WITH ALL FAULTS.
TO THE MAXIMUM EXTENT PERMITTED BY UNITED STATES FEDERAL AND STATE LAW, VALUE VELO EXPLICITLY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, HIGH-QUALITY INFRASTRUCTURE, SAFETY, AND NON-INFRINGEMENT.
Consumer Notice: Some US states do not allow limitations on how long an implied warranty lasts or the exclusion of implied warranties, so parts of the above disclaimers may not apply to you.

4. Assumption of Risk & Release of Liability

Bicycle riding is an inherently dangerous sport and recreational activity. By purchasing a bicycle from Value Velo, the buyer voluntarily assumes all risks associated with its operation, including the risk of severe physical injury, disability, or death.
You explicitly agree to release, waive, discharge, and hold harmless Value Velo, its owners, employees, and suppliers from any and all claims, demands, or causes of action resulting from accidents, component failures, or mechanical breakdowns occurring after the product has been handed over to you.

5. Limitation of Liability

IN NO EVENT SHALL VALUE VELO, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, PERSONAL INJURY, PROPERTY DAMAGE, OR MEDICAL EXPENSES ARISING OUT OF OR IN CONNECTION WITH THE USE OF OUR PRODUCTS.
VALUE VELO’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF A BICYCLE PURCHASE SHALL NOT EXCEED THE ACTUAL PURCHASE PRICE PAID BY YOU FOR THE SPECIFIC BICYCLE GIVING RISE TO THE LIABILITY.

6. Governing Law & Choice of Venue

These Terms of Service and any separate agreements whereby we provide you products or services shall be governed by, and construed in accordance with, the laws of the State of [Insert Your US State, e.g., Delaware/California], without regard to its conflict of law principles.
Any legal action, suit, or proceeding arising out of these Terms must be brought exclusively in the state or federal courts located in [Insert Your County, State].
